Överklagan till Högsta Förvaltningsdomstolen

Jag har nu inskickat min överklagan till Högsta Förvaltningsdomstolen av Kammarrättens i Stockholm domar 2013-07-04 i mål 3141-13 och 3160-13 att avslå mina överklaganden till Kammarrätten av KTHs beslut att inte lämna ut identifierad e-post mellan rektor-dekan-prefekt-avdelningsföreståndare-linjeledare rubricerad Gomorron Sverige och MST/BodyandSoul.

Quantum Contradictions 5: The Periodic Table



The question How Good is the Quantum Mechanical Explanation of the Periodic System? is answered by Eric Scerri by: Not Very Good:
  • I would like to issue a caution regarding the extent to which the periodic table, for example, is truly explained by quantum mechanics so that chemical educators might refrain from overstating the success of this approach.
Quantum mechanics offers a standard explanation in terms of the Hydrogen orbitals combined with Pauli's exclusion principle identifying electrons by 4 quantum numbers (n, l, m, s) with n = 1, 2, 3,... the principal shell number,  l = 0,..., n -1 the azimuthal quantum number, m ranging from - l  to + l the magnetic quantum number and s = +- 1/2 the spin quantum number. 

The basic idea is that shells are sequentially filled with electrons in a certain order (s,p,d,e,..,) within each shell.  The trouble is that shells are not sequentially filled with an inner shell being full before an outer shell starts to get filled. The observed order is instead (usually) by the number  n + l referred to as Madelung's rule complemented by Hund's rule, which both appear to be introduced ad hoc without quantum mechanical rationale. 

The quantum mechanical explanation of the periodic table thus requires three additional ad hoc rules (Pauli, Madelung and Hund) and the advice of Scerri to not overstate its success seems to be well founded.

It is in fact unclear what the standard quantum mechanical explanation based on Hydrogen orbitals, does offer as explanation of the periodic table.  Even the basic numbers 2, 8, 8, 18, 18, 32,..., of electrons in filled shells require doubling from the sequence of Hydrogen orbitals 1, 4, 9, 16,..., by ad hoc introduction of spin combined with Pauli's exclusion principle.

And so it remains to give a more convincing explanation of the periodic table using a form of quantum mechanics without ad hoc attributes. Quantum Contradictions 4: Helium isoelectronic sequence

The postulated ground state of 2-electrons atoms/ions according to the NIST Atomic Spectra Database,  is the 1s^2 state of the He isoelectronic sequence (2 electrons with opposite spin and identical spatial wave functions with exponential decay away from the kernel). But the energy of the postulated 1s^2 state is not the observed energy as shown in the following list with the experimental value (in eV) first and the larger energy of the 1s^2 state in parenthesis:
  1. He : - 79 (- 74.80)
  2. Li+ : - 198.09 (- 193.80)
  3. Be+2 : - 371.60 ( - 367.20)
  4. B+3 : - 599.58 ( - 595.00)
  5. C+4 : - 882.05 (- 877.20).
It appears that in the true ground state with energy in accordance with observation, the two electrons are separated into roughly speaking two half-shells together creating an electron wall shielding the kernel. The appearance of such a wall could possibly explain why a third electron will be pushed away into an outer shell without resort to any two-electron Pauli exclusion principle.

The fact that the postulated ground state in the He isoelectronic sequence is not the actual ground state gives the postulated quantum mechanics support of the periodic table, based on Hydrogenic orbitals combined with Pauli's exclusion principle, a bad start with possibly catastrophical consequences concerning scientific rationale.

PS Pauli's exclusion principle is an ad hoc assumption which serves to eliminate e.g. a 1s^3 state of Lithium with 3 electrons sharing a 1s state, which shows to have energy smaller than that observed and so must be unphysical in some sense. If already the 1s^2 state is unphysical, this may as suggested prevent the appearance of a 1s^3 state without any ad hoc exclusion assumption.

Kammarrätten (i Stockholm) Vränger Lagen att Passa KTH

Kammarrätten i Stockholm har avslagit mitt överklagande av KTHs beslut att inte lämna ut e-post mellan befattningshavare på KTH (rektor-dekan-prefekt-avdelningsföreståndare) avseende ärendena "Gomorron Sverige" (mål 3141-13) och "MST/BodyandSoul" (mål 3640-13)).

Kammarrätten i Stockholm går därmed emot dom 212-13 i Kammarrätten i Göteborg trots att Kammarrätten i Stockholm explicit anger att "Hans (mitt) fall liknar det fallet (fallet i Göteborg)".

Den avgörande frågan i båda fallen är om e-post skall anses vara upprättad genom att vara "färdigställd" enlig Tryckfrihetslagen TF Kap 2 paragraf 7 första stycket. 

Kammarrätten i Göteborg gör bedömningen att
  • "interna e-postbrev som inte ska omarbetas eller bli till ärende ska betraktas som (färdigställda och därmed) upprättade genom att de sänds". 
Kammarrätten i Stockholm gör en motsatt bedömning (utan kommenter till domen i Kammarrätten i Göteborg) genom att först hänvisa till prop 1975/76: 160 s. 143:
  • "För att en handling skall anses vara färdigställd krävs inte något särskilt formellt förfarande från myndighetens sida".
och sedan argumentera på följande sätt:
  1. "Detta innebär enligt Kammarrättens mening emellertid inte att e-postmeddelanden kan anses färdigställda, och därigenom upprättade, endast genom avsändande inom myndigheten".
  2. "Om så vore fallet skulle inte bestämmelsen i TF kap 2 paragraf 8 fylla någon funktion".
  3. "Det krävs alltså något ytterligare handlande från myndighetens sida för att handlingarna ska anses färdigställda (jfr RÅ 1998 ref 30 och 52)".
  4. "I detta fall har det inte framkommit några omständigheter som gör att meddelandena kan anses ha färdigställts av KTH". 
Hänvisningen till RÅ 1998 ger exempel på ( ref 30) en handling som färdigställts genom att den "satts in i en pärm" och (ref 52) mötesanteckningar som färdigställts genom att ha sänts ut till ledamöterna i kommunledningsgrupp. 

Om vi utsätter Kammarrättens i Stockholm argumentering 1. - 4. för en granskning, så finner vi först följande motsägelse:
  • Enligt TF så krävs inget särskilt förfarande för färdigställande.
  • Enligt Kammarrätten i Stockholm krävs ytterligare handlande (utöver avsändande) från myndighetens sida för färdigställande. 
Kammarrätten i Stockholm tar sig alltså friheten att skriva om TF och gör detta genom ett dunkelt nyuppfunnet motsägelseargument med hänvisning till TF kap 2 paragraf 8.

Det mest anmärkningsvärda är dock punkten 4. där det meddelas att "det inte framkommit några omständigheter", som med hänvisning till referensen RÅ 1998 ref 30 skulle kunna vara att handlingarna "satts in i en pärm".  

Frågan är nu hur Kammarätten i Stockholm kan veta att handlingarna tex inte "har satts in i en pärm" och därmed färdigställts? För att kunna veta detta måste Kammarrätten fått information från KTH utöver den som finns i KTHs avslag av min begäran, som endast innehåller följande (meningslösa tautologiska) nollinformation:
  • "De interna e-postmeddelanden som efterfrågats är var sig inkomna, expedierade eller på annat sätt upprättade, varför de inte är att betrakta som upprättade och därmed inte som allmänna handlingar".
Men att någon sådan ytterligare information lämnats av KTH till Kammarrätten, har inte meddelats mig, vilket enligt lagen skall ske om så varit fallet. 

Det finns härvid bara två möjligheter: 
  • Antingen argumenterar Kammarrätten utan informationsunderlag, då i strid med lagen. 
  • Eller så finns underlag i form av information från KTH, som dock undanhållits mig, då i strid med lagen. 
Det skall bli intressant att få veta vilket som är fallet, när jag nu överklagar till Högsta Förvaltningsdomstolen.

Till misstanken att KTH interfererat med SVT för att stoppa mitt framträdande i Gomorron Sverige, läggs nu misstanken att KTH interfererat med Kammarrätten i Stockholm för att dölja påverkan av SVT. Att Kammarrätten kan skriva att "det inte framkommit några omständigheter" utan att på minsta sätt ha undersökt vilka "omständigheter" som  förelegat via information från KTH, verkar omöjligt. 

Notera att eftersom enligt TF det inte krävs något särskilt formellt förfarande av myndighet för att att en handling skall vara färdigställd, så är det inte möjligt att avgöra att en handling inte är färdigställd, annat än genom att den uppfyller de explicit angivna kriterierna i TF Kap 2 paragraf 9 (utkast, koncept, avsedd för vidare bearbetning) för att en handling inte skall vara färdigställd. Denna korrekta tolkning används av Kammarrätten i Göteborg, som inte vränger lagen.

Att Kammarrätten i Stockholm vränger lagen, som den gör i mitt fall, är mycket anmärkningsvärt, och borde kunna uppmärksammas av media som värnar om ett rättssamhälle.

PS1 Syftet med TF är att värna om yttrandefrihet och möjlighet till insyn i myndighetsutövning för individen (och inte att ge myndighet möjlighet att hindra individuell yttrandefrihet och dölja maktutövning). Kammarrätten i Göteborg tolkar TF till individens fördel i enlighet med detta syfte, medan Kammarrätten i Stockholm misstolkar TF till nackdel för individen och fördel för myndigheten, i bjärt kontrast till lagens syfte, vilket kan ses som en anpassning till den linjestyrning som nu kopplar sitt förlamande grepp över akademin enligt Academic Rights Watch. 

PS2 Kammarrätten förbigår helt de "omständigheter som framkommit" i min överklagan, nämligen att e-posten direkt kopplar till aktioner från KTH som allvarligt har skadat min akademiska verksamhet, och som jag har rätt att ta del av om den finns dokumenterad som e-post. När Kammarrätten skriver att "det inte framkommit några omständigheter" betyder det att Kammarrätten inte funnit något därför att Kammarrätten har stängt ögonen och inte sökt något, men det är inte så en rättslig instans skall fungera.     

PS3 RÅ 1998 ref 30 och 52 kör över Kammarrätten och tolkar TF till individens fördel. Högsta Förvaltningsdomstolen kan förväntas göra detsamma i mitt fall.

Quantum Contradictions 3: Hydrogen Orbitals



The electron structure of an atom is supposed to be described by a wave function defined by 4 (integer) quantum numbers (n,l,m,s) with  n = 1,2,..., the principal (shell) quantum number,  l = 0,.., -1, the azimutal quantum number, m ranging from -l to +l the magnetic quantum number  and s = +- 1/2 the spin quantum number.

The 3 quantum numbers (n,l,m) describe the wave functions for excited states (eigen-functions or orbitals) of the Hydrogen atom, with the 1 wave function for n = 1 representing the s-state of the first shell, the 1+ 3 = 4 wave functions for n = 2 representing the p-states of the second shell, and the 4 + 5 = 9 wave functions for n = 3 representing the d-states of the the third shell et cet. The connection is that the Hydrogen eigen-functions form a basis allowing the electronic structure of a multi-electron atom to be represented by linear combinations.

We see that the number of Hydrogen orbitals equals n^2, which is to be compared with the observed number 2n^2 electrons in a complete shell, with He (2 electrons in shell 1), Ne (2 electrons in shell 1 and 8 in shell 2), Ar (2+8+8), Kr (2+8+18+8), et cet. A factor 2 is thus missing and this factor was introduced by adding a 4th quantum number as the two-valued spin quantum number s. 

The spin quantum number thus came out as a forced resolution of a contradiction between observed electronic shell structure with 2n^2 electrons in a complete shell with a structure represented by n^2 Hydrogen orbitals. But a motivation that a multi-electron shell structure should resemble the s-p-d structure of the orbitals of the one-electron Hydrogen atom, was missing.

The structure of the periodic table is thus claimed to be inherited from the structure of Hydrogen orbitals augmented by spin, as the basic experimental support of quantum mechanics.  But there are irregularities of the periodic table which require additional (ad hoc) assumptions such as Madelung's and Hund's rules, and so the question to be considered in an upcoming post is:

Quantum Contradictions 2: Pauli Exclusion Principle



Wolfgang Pauli stated in General Principles of Quantum Mechanics (1958) on the Pauli Exclusion Principle (PEP):
  • The fact that quantum mechanics yields more states than actually occur in nature (multiD wave function), is still a puzzle and it is hoped that a future theory of elementary particles will bring a deeper insight into the essence of the this restricted choice of nature (symmetric or antisymmetric multiD wave function).
But PEP is still a puzzle and can be viewed as the basic puzzle of quantum mechanics which harbors  a basic contradiction from two conflicting ad hoc assumptions:
  1. An atom with N electrons is described by a wave function as solution to a linear scalar Schrödinger equation in 3N space dimensions with a richness beyond any reality and imagination, which can viewed as a scientific monster.  
  2. To balance the richness and come to grips with the monster, a restriction to symmetric or antisymmetric wave functions is made.    
An ad hoc rich Ansatz is thus restricted ad hoc, which violates Ockham's Razor requiring science to avoid detours: A rational scientific approach would be to start out with a different mathematical model in the form of a system in N wave functions depending on 3 space dimensions as solution to a coupled system of N scalar wave equations in 3 space dimensions, as suggested by Hartree directly after the multiD Schrödinger equation was presented in 1925, and explored in Many-Minds Quantum Mechanics.

Pauli was never happy with his principle, even if it gave him the Nobel Prize in Physics "for the discovery of the Pauli Principle", which he does not hide in his Nobel Lecture (as another contradiction):
  • Already in my original paper I stressed the circumstance that I was unable to give a logical reason for the exclusion principle or to deduce it from more general assumptions. I had always the feeling and I still have it today, that this is a deficiency.

Quantum Contradictions 1


The Mystery of the Quantum World by Euan Squires presents contradictions troubling quantum mechanics, which have never been resolved despite intense efforts by sharp minds over nearly 100 years. The contradictions arise from an insistence to (i) choose a Linear Scalar MultiD Schrödinger Wave Equation as the basic mathematical model, and then (ii) as a consequence give wave function solutions a statistical interpretation as probabilities of particle configurations, together referred to as the Copenhagen Interpretation (CI) of Bohr, Born and Heisenberg.

In mathematics, one contradiction leads to infinitely many contradictions and accordingly CI is loaded with contradictions or mysteries (see also Inconsistency of the CI by C. Stuart):
  1. Statistics on microscopic scales requires microscopics of microscopics, which is contradictory.
  2. CI is focussed on what physicist can observe and measure and leaves out the essence of microscopic physics, namely what makes atoms and molecules behave the way they do, without being observed or measured. 
  3. CI includes "collapse of the wave function" upon observation, as a mystery without explanation.
  4. CI includes action at distance beyond Coulomb forces named "entanglement", as a mystery without explanation. 
  5. CI as a multiD model is uncomputable and thus of no real scientific value. 
  6. CI is not a model of reality and as such is more of pseudo-physics than physics.      
All these contradictions and mysteries would disappear if the Linear Scalar MultiD Schrödinger Wave Equation was replaced by a suitable system of non-linear scalar wave equations in 3 space dimensions, e.g. the Hartree model of Many-Minds Quantum Mechanics. This would offer computable models allowing computational observation without the interference resulting from physical observation connecting the observer to the observed into the mess of CI. 

The biggest mystery is thus how the the Linear Scalar MultiD Schrödinger Wave Equation has been able to survive as the basic model of the microscopic world.  

New Theory of Flight Presented at 2nd AIAA High Lift Prediction Workshop


The Direct Fem Simulation (DFS) of the flow of air around an aircraft underlying the New Theory of Flight, which was rejected 2012 by AIAA Journal and is now in review by Journal of Mathematical Fluid Mechanics, was presented by Johan Jansson at the 2nd AIAA High Lift Prediction Workshop in San Diego June 22-23, 2013.

As shown in the Agenda and Summary our contribution stands out as the most advanced simulation technique based on ab initio solution of the incompressible Navier-Stokes equations, without any turbulence model and with a slip boundary condition as an accurate model of small skin friction of high Reynolds number flow, using a stabilized adaptive finite element method.  

Our results of the workshop show that ab initio simulation (DFS) of the complex aerodynamics of complete aircraft during start and landing is possible, which reveals the true secret of flight and opens the possibility of constructing fully realistic flight simulators.
